Terms & Conditions
These Terms & Conditions (“Terms”) govern your use of the BETTR OFF mobile application (the “Service”), operated by PL Core GmbH (“BETTR OFF”, “we”, “us”). The provider’s full details are set out in the Imprint. By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. Eligibility
You must be at least 18 years old to use BETTR OFF. The Service is intended for adults who want to reduce or stop gambling and is not directed at minors. By using the Service you confirm that you are 18 or older.
2. What BETTR OFF Is — and Is Not
BETTR OFF is a self-help and accountability tool. It provides self-assessment, habit tracking, blocking features, and supportive content based on problem-gambling research.
No medical or clinical service. BETTR OFF is not a medical device, a healthcare provider, or a clinical service. It does not provide medical, psychological, therapeutic, financial, or legal advice, diagnosis, or treatment. BETTR OFF is not a substitute for professional or clinical care, therapy, counselling, or treatment of any kind, and must not be used as one.
No cure, healing, or outcome promise. BETTR OFF makes no representation, warranty, guarantee, or promise that it will treat, cure, heal, prevent, or reduce gambling addiction, problem gambling, or any other condition, or that it will produce any particular result. Any progress depends on many factors outside our control, including your own circumstances and efforts. Self-assessment scores are indicative only and are not a clinical diagnosis.
Seek professional help. Always seek the advice of a qualified doctor, therapist, or other professional regarding any medical or mental-health condition. Never disregard, avoid, or delay seeking professional advice because of anything you have read or seen in the Service. In an emergency or crisis, contact a local emergency service or a gambling helpline immediately.
You use the Service at your own responsibility. You acknowledge that you use BETTR OFF voluntarily and on your own responsibility, and that decisions about your health, finances, and treatment remain yours and those of the professionals you consult. To the fullest extent permitted by law, we accept no liability for reliance placed on the Service as if it were professional or clinical advice. This section applies together with, and does not limit, Section 9 below.
3. Your Account
Some features require an account. You are responsible for keeping your login credentials secure and for activity that occurs under your account. Please provide accurate information and keep it up to date.
4. Subscriptions, Billing, and Cancellation
Full access to BETTR OFF requires a paid subscription, offered as an auto-renewable in-app purchase through Apple.
- The current price, billing period, and any free trial are shown on the purchase screen in the app before you confirm.
- Payment is charged to your Apple Account at confirmation of purchase.
- Your subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
- You can manage or cancel your subscription, and turn off auto-renew, in your Apple Account settings.
- If you start a free trial and subscribe before it ends, any remaining trial time is forfeited.
- Purchases are processed by Apple and are subject to Apple’s terms. Refunds are handled by Apple in accordance with its policies.
Right of withdrawal (EU/EEA consumers)
As a consumer you generally have a 14-day right of withdrawal for digital purchases. By starting to use the paid digital content immediately, you may expressly consent to the performance beginning before the withdrawal period ends and acknowledge that you thereby lose your right of withdrawal. Where purchases are made through Apple, Apple’s cancellation and refund process applies.
5. Acceptable Use
You agree not to misuse the Service, including not to: (a) use it for any unlawful purpose; (b) attempt to circumvent, disable, or interfere with security or blocking features; (c) reverse engineer, decompile, or copy the app except as permitted by law; or (d) disrupt or overload our systems.
6. Trusted Person Feature
If you add a trusted person, you are responsible for ensuring you have their consent to share the information you choose to share with them. You can remove a trusted person at any time in the app.
7. Intellectual Property
The Service, including its software, content, design, and trademarks, is owned by BETTR OFF or its licensors and is protected by law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app for its intended purpose. All rights not expressly granted are reserved.
8. Availability and Changes
We may update, change, or discontinue features of the Service. We aim for high availability but do not guarantee uninterrupted or error-free operation. We may update these Terms; material changes will be communicated by appropriate means, and continued use after changes take effect constitutes acceptance.
9. Limitation of Liability
To the extent permitted by law, BETTR OFF is provided “as is”. We are liable without limitation for intent and gross negligence and under mandatory law (including the German Product Liability Act and for injury to life, body, or health). For slight negligence we are liable only for breach of an essential contractual obligation, and limited to the foreseeable, typical damage. Any further liability is excluded. Nothing in these Terms limits liability that cannot be limited under applicable law.
10. Termination
You may stop using the Service at any time and delete your account in the app. We may suspend or terminate access if you materially breach these Terms.
11. Governing Law
These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of your country of residence remain unaffected.
